1. SCOPE AND GENERAL INFORMATION
The terms and conditions set forth hereunder shall govern the access to, navigation and use of the web site www.bulldogtv.es (hereinafter, the Site) created by BULLDOG TV SPAIN, S.L. (hereinafter, BULLDOG TV).
BULLDOG TV is a Spanish company with offices located at C/Orense 58, 10th floor, door B, 28020 Madrid (Spain), duly registered with the Commercial Registry of Madrid (Volume 33.613, Sheet 150, Section 8, Page number M-605051) and with Tax Identification Number: B87325205. The access to the Site is free of charge and implies the acceptance of the terms and conditions included in this Legal Notice.
2. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS OF THE SITE
BULLDOG TV is the owner, or has the necessary license on all intellectual and industrial property exploitation rights of the Site, those elements forming the visual appearance, its contents including all pictures, videos, audios, documents, graphics, drawings, as well as the trademarks, logotypes, commercial names or any other distinctive signs, technology, texts, links, recordings, photographs, software, computer programmes or databases that are included in the Site.
USER’s access and navigation on the Web Site shall in no event imply a total or partial withdrawal, transfer or licensing of the aforementioned rights.
In addition, it is absolutely forbidden to modify, copy, reuse, exploit, reproduce, make available to the public, make secondary or subsequent publications, upload files, send by e-mail, transfer, use, treat or distribute in any way (in whole or in part) the contents included in the Site for public or commercial purposes without the express and written authorization of BULLDOG TV, or when applicable, of the third party holder of the rights.
3. RESPONSIBILITIES
A. OPERATING THE SITE AND ITS SERVICES
BULLDOG TV does not warrant the availability, level of quality, interfacing and functioning of the Site, and continuity of the Site and its contents. When possible, BULLDOG TV shall notify in advance through the Site, of interruptions, suspensions or discontinuances on the Site, its Content and/or Services.
BULLDOG TV shall not be liable for any damages or prejudices of any kind relating to the unavailability or the continuity of the Site and/or its contents, its lack of updating or any failure to access the Site, the absence of viruses or other elements in the content, which could produce alterations in the computer system (software and hardware) or in the electronic documents and indexes stored in the computer system.
The USER is aware of, and voluntarily accepts, that use of the Site, the Services and the Content takes places, in all cases, under the USER´s own risk, for which reason he or she shall adopt all measures necessary for the purposes of minimizing risks, including any security measures which may be necessary to guarantee anti-virus and data recovery procedures. Unless law expressly dictates otherwise, BULLDOG TV neither guarantees nor assumes any responsibility whatsoever in respect of access to and use of the Web Site and its Content and/or the Services incorporated therein.
B. USE OF THE SITE AND ITS CONTENTS
USER hereby undertakes to use the Site, the Content and the Services incorporated therein in a diligent and correct manner. BULLDOG TV does not control the use of the Site made by the USERS and, therefore, does not warrant such use to be made according to law, this Legal Notice or any other particular condition set forth by BULLDOG TV. BULLDOG TV is not liable for any damages or prejudices of any kind arising as a consequence of the misuse of the Site by the USERS.
C. OWN CONTENTS
BULLDOG TV provides in good faith all contents included in the Site by using information obtained from its own sources or from third parties. Based on the foregoing and on the size of the information that can be accessed through the Site, BULLDOG TV does not warrant the total accuracy or updating of the data and texts available, although it makes reasonable commercial efforts to make it possible.
BULLDOG TV does not warrant the suitability of the Site for any particular activity or the suitability of the contents for any particular purposes; as a result of this, access to the Site and use of the information and contents contained therein, is made only and exclusively under the USER’s responsibility.
D. THIRD PARTIES CONTENTS
BULLDOG TV is not liable in any case, directly or indirectly, for any content, information, communication, point of view or statement of any kind USERS or any third person or entity may issue and communicate, broadcast, transmit or show through the Site.
E. CONTENTS AND SERVICES RESIDING OFF THE SITE
The Site makes available to the USERS technical link devices, as well as links, directories or search tools that allow access to web sites managed by third parties. BULLDOG TV does not exercise any ownership on them and does not commercialize or offer their contents or services. Therefore, BULLDOG TV does not assume any liability of any kind, whether direct, indirect or subsidiary, with regard to the aforementioned web sites and their contents.
To place any kind of link in the Site, the interested parties will have had to previously petition BULLDOG TV for an express and written authorization. BULLDOG TV reserves the right to unilaterally withdraw, at any given time, the links which appear on its Site. Without prejudice to this, any link providing access to specific contents or services offered by BULLDOG TV (“deep linking”) is expressly forbidden.
F. UNSOLICITED SUBMISSIONS

Please refrain from sending or submitting to BULLDOG TV through this Web Page or though the contact emails or contact form of the Web Page, any idea, format, work, story, treatment, concept, bible, script, graphic work, artwork, music, software code or other creative material or information, as BULLDOG TV does not accept unsolicited submissions.

If, in violation of the above, you submit in any way any material to BULLDOG TV, such submission shall in no event subject BULLDOG TV to any obligation of any kind, either express or implied, including, without limitation, confidentiality, attribution, compensation, review, production or otherwise, and BULLDOG TV shall not be liable for any exploitation, use, or disclosure of any such submitted material. You hereby agree that no confidential or fiduciary relationship is intended or created by reason of the submission of any unsolicited submission by you, and that you have no expectation of any review, compensation or consideration of any type. You hereby release BULLDOG TV or its related entities, to the maximum extent allowable by law, of and from, and irrevocably waive, any and all claims, costs, demands, liabilities, fees, penalties and other expenses of any kind whatsoever, known or unknown, that may exist or arise relating to, arising out of, or in connection with any such materials, and/or BULLDOG TV’s or its related entities’ use or disclosure of the same.

G. SOLICITED SUBMISSIONS

In case of submissions expressly solicited or authorized by BULLDOG TV, they will be ruled by a written agreement that will be signed by both parties prior to the submission of the material. Any materials submitted to BULLDOG TV without such a written agreement will be considered unsolicited submissions to all effects.
4. DURATION AND MODIFICATION OF THE PRESENT LEGAL NOTICE
BULLDOG TV may change or modify this Legal Notice at any time, by replacing the terms and conditions with new applicable ones. Using the Site after the implementation of changes implies acceptance of those changes. New terms and conditions on the Legal Notice will be effective when posted in the Site.
5. ASSIGNMENT
The USER may not assign, transfer, encumber or subrogate in favour of third parties, the rights and obligations set forth in the terms and conditions set forth herein.
BULLDOG TV may assign, transfer encumber or subrogate in favour of third parties, totally or partially, the rights and obligations assumed pursuant to the contractual relationship, to any third party, it being understood hereby that the USER grants sufficient authorization to this effect.
6. PRIVACY AND COOKIES POLICY

According to Spanish Organic Law 3/2018 of 5 December on the Protection of Personal Data and to the General Data EU Regulation 2016/679 of THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of April 27, 2016 regarding the protection of natural persons with regard to the processing of personal data and the free circulation of these data and by which it repeals Directive 95/46/EC (General Data Protection Regulation) (“BULLDOG TV”), with tax identification number B87325205 and address at C/Orense 58, 10th floor, door B, 28020 Madrid (Spain); hereby informs of its Data Protection Policy to the users (“USERS”) of BULLDOG TV´s web page accessible through the domain name www.bulldogtv.es (the “Web Site”):

BULLDOG TV does not collect any data from USERS unless they voluntarily request or submit any information through the sections “Contact” of the Web Page or unless they consent to cookies in the terms foreseen herein.

A. “CONTACT” SECTIONS OF THE WEB PAGE

(i) Personal Data Filing System

The personal data collected through the contact email/form of the Web Site (the “Personal Data”) will be treated confidentially and with the sole purpose of providing the USER with the requested information and/or of responding to the request or query filed by the own USER. The data collected or generated or requested by BULLDOG TV as a consequence of the exchange of emails between the USER and BULLDOG TV or by uploading the contact form will be included in a filing system under the responsibility of BULLDOG TV.

(ii) Purpose and basis of the processing

BULLDOG TV shall process the USER´s Personal Data for the sole purpose of providing the USER with the requested information and/or of responding to the request or query filed by the own USER.

The legitimate basis for the processing of USER´s Personal Data is the USER´s own initiative to send a question/query/request to BULLDOG TV and BULLDOG TV´s wish to respond to such initiative. BULLDOG TV reserves the right not to respond to messages sent to the contact emails/forms, at its own free discretion.

(iii) Compulsory or optional nature of the requested information

BULLDOG TV does not require any compulsory information. It is the USER´s discretion to provide contact data for BULLDOG TV to be able to respond the query or request. The information provided by the USER in the contact emails/forms is the information that the USER has freely decided to include; BULLDOG TV does not require any information to be included or disclosed. BULLDOG TV urges USERS not to include sensitive information in their requests and to only disclose to BULLDOG TV the information necessary to solve their query.

In case the USER wishes to participate in casting processes or to participate as visitor in any program, this web page offers the appropriate links that will address the USER to corresponding Web pages.

The denial to provide the contact information, the withdrawal of the consent given or the exercise of the rights of erasure, objection or restriction of the processing could impair BULLDOG TV from responding to the USER´s request or query.

(iv) Data Protection Officer

BULLDOG TV has appointed the Head of the Legal Department as Data Protection Officer, with contact email privacidad@bulldogtv.es.

(v) Special categories of data

BULLDOG TV does not require any special categories of data. Regardless of the foregoing, the USER provides BULLDOG TV with the information it wishes, freely, under the USER´s own responsibility. BULLDOG TV urges the USER not to provide sensitive or delicate information through the “Contact” email/form.

(vi) International transfer of data

There are no international data transfers.

(vii) Exercise of Rights

The USER can exercise his/her rights of access, rectification, erasure, objection, restriction of processing and data portability by notice in writing to BULLDOG TV´s Data Protection Officer by writing an email to privacidad@bulldogtv.es including the following information: (a) Name, surname and copy of his/her identification card or equivalent document (and, if acting on behalf of another person, the appropriate authorization in this regard); (b) Purpose of the request and (c) Address for notification.

If USER considers that his/her data have been treated inappropriately, the USER can exercise his/her right to file a claim with Agencia Española de protección de Datos (www.agpd.es).

(viii) Commitments of the USER regarding data protection

THE USER undertakes to:

Provide current, accurate and truthful information. Inform BULLDOG TV about any changes in the information provided, through the procedure foreseen above for the exercise of the right of rectification.

Comply with his/her obligation of secrecy regarding all personal data and confidential information to which he/she has access because of his/her exchange of emails with BULLDOG TV, obligation that has an indefinite duration.

(ix) Maintenance in time of USER’s Personal Data

BULLDOG TV shall keep USER´s Personal Data for as long as it is necessary to solve the USER´s request or query, and for any time necessary to solve any civil or other kind of responsibility, if any.

(x) Security measures

BULLDOG TV has undertaken the technical and organizational measures necessary to
ensure the security of personal data and to avoid their alteration, loss, unauthorized access or processing, taking into account the state of technology, the nature of the data stored and the risks to which they are exposed, either from human action or from the physical or natural environment.

(xi) Intellectual Property Policy

Please refrain from submitting to BULLDOG TV through the contact email/form of the web site, any idea, format, work, story, treatment, concept, bible, script, graphic work, artwork, music, software code or other creative material or information, as BULLDOG TV does not accept unsolicited submissions.

(xii) Agreement of the USER

The USER, by sending a message to the contact email/form of the Web Site declares and acknowledges to have read and understood this PRIVACY AND IP POLICY and expressly consents to the content therein.

B. COOKIES POLICY

The USER agrees to the use of cookies and tracking files that our website uses, through the service of Google Analytics. We place cookies to measure and analyze the site´s users behavior. BULLDOG TV has access to some of those data for the purpose of providing and improving our web services, as well as to measuring, analyzing and personalizing the visits to the website.

Cookies will not be set up on your computer unless and until you consent to their being installed and used by clicking on the “I accept” button.

Additionally, the USER accepts the use of cookies and of files tracking IP addresses in order to enable BULLDOG TV to collect data for statistical purposes, such as date of first visit, number of times you have visited, date of last visit, URL and domain you have come from, browser used and screen resolution. The information collected is totally anonymous, and in no event can it be associated to a particular and identified user.

Finally, the USER accepts the use of session-only cookies that relate to language settings, as well as third party social networks plug-ins (e.g. Facebook, Twitter).

In any event, the USER may prevent the installation of cookies or delete the ones that already had been installed, at any time, through the configuration of the USER´s browser, as well as through the use of specific applications. 7. GOVERNING LAW
This Legal Notice and the relationship between USER and BULLDOG TV shall be governed and construed in accordance with Spanish Law.
The parties submit any and all disputes which may arise out of the interpretation and/or fulfilment of this Legal Advice to the Judges and Courts of the City of Madrid, Spain, expressly waiving their right to any other jurisdiction.
